Abortion, like many moral teachings isn’t born out blatantly within the Bible. This is one of the reasons you need to read the Bible as a totality to truly understand it. In the case of abortion, the act is condemned by the commandment which says thou shalt not murder. Since the act of murder is killing a human being in an act not of self-defense than killing an unborn human is also murder. Since abortion destroys a human being, and since the unborn can never have acted out of aggression at this point, there is no justification for taking that life.
As for the death penalty, this one is a little more complex.
In the Old Testament Jesus hadn’t yet died on the cross. You might ask yourself what that has to do with anything. Well it has everything to do with the death penalty, as does the phrase: I came not to destroy the law but to fulfill it.
Any time innocent blood was spilt in an act of murder it required atonement of some kind, that is in the Mosaic law if I recall right. When Jesus died on the cross he took upon himself the guilt of all mankind becoming the Scape Goat, and the Sacrificial Lamb while dieing for our sins. There is no contradiction between the Old and New Testaments here.
